What happened?
Wilber Rafael Garces Perez, a 28‑year‑old Venezuelan, was shot in the back during an ICE raid in Texas. He suffered a clavicle fracture and was left with a bullet inside his back.
The case was taken to Judge Orlando Garcia, a Clinton‑appointed federal judge, who has issued a temporary restraining order preventing Garces Perez from being deported until a hearing on September 30.
Garces Perez’s lawyer, Kate Lincoln‑Goldfinch, said the order “keeps the case moving forward” while the man receives medical care.
DHS claims the man was an “illegal alien” whose work permit had expired, and the agency said it was fixed for an unarmed, humane arrest – a claim contested by the lawyer and protesters.
Protesters swarmed the Austin courthouse, demanding ICE leave the city; Capitol Representative Joaquin Castro has called for an independent investigation.
