Felipe de Jesus Hernandez Marcelo, a 28-year-old immigrant, remains in detention after an immigration judge in Omaha denied his bond request. Hernandez was shot during a robbery in Muscatine, Iowa and sought police assistance after his injury but was arrested on a previous warrant.

After being shot multiple times and struggling to recover, Hernandez turned to law enforcement for help only to end up in ICE custody. His legal team is arguing for his release as he is pursuing a U visa, meant to protect crime victims, but the immigration judge stated that while he may apply for the visa, there is uncertainty about his eligibility.

Judge Alexandra Larsen noted Hernandez's past violations as a reason for denying bail, suggesting he might pose a flight risk. Hernandez has been separated from his 9-year-old son and has missed medical appointments due to his continued detention. His lawyer vows to keep fighting for his release, citing evidence that he does not present a risk to the community.
