A judge has ordered the immediate release of Kilmar Abrego Garcia, who was mistakenly deported in March and brought back to the US to face criminal charges, from immigration custody. Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority, Judge Paula Xinis wrote in her order. Mr. Abrego Garcia had initially been sent to a prison in El Salvador earlier this year in an error acknowledged by the US government. He was returned to the US to face human smuggling charges and has been held since then. Judge Xinis further noted that the government did not have a removal order, which restricts it from deporting Mr. Abrego Garcia at this juncture. The Trump administration had contended that Mr. Abrego Garcia is affiliated with the violent MS-13 gang, a claim he denies. This spring, a group of alleged gang members was controversially flown to El Salvador's CECOT prison despite a previous court order against Mr. Abrego Garcia's deportation. He has pleaded not guilty to the smuggling charges, related to a trial in Tennessee. Now free on bail, Judge Xinis has instructed him to adhere to the conditions of his release.
