New video evidence comes to light. In the second day of a preliminary hearing for 23‑year‑old Tyler Robinson, prosecutors showcased a clip that allegedly shows him sprinting across a campus rooftop, weighing down an object, after the fatal shooting of conservative activist Charlie Kirk on 10 September 2025.
The shot, held by a police camera, was projected in the Utah courtroom. Robinson’s defense team, led by attorney Kathy Nester, immediately objected, claiming the footage was pre‑edited to influence jurors and that the footage was recorded by an unknown cameraman who never took the stand.
Prosecutors argue that the clip, combined with earlier CCTV showing Robinson’s vehicle entering the parking garage, watching a man in a maroon shirt and Converse shoes roam the campus, establishes a clear chain of actions leading up to the shooting. The suspect on the footage was noted walking with a slight limp and later leaving the rooftop after dropping the object.
A rifle was later recovered near a wooded area where the suspect allegedly exited. Judge Graf, who is to decide whether the evidence warrants a full trial, will not make a guilt determination but will weigh the strength of the prosecution’s case.
If the court approves the charge, Robinson faces aggravated murder and the prosecution is pursuing the death penalty. The defense seeks to eliminate the most serious penalty and to have the video evidence excluded altogether.
